These terms of use are effective as of 1st January 2024.
1. Accepting These Terms
Welcome to AptFuel, a platform provided by Raffles Energies Limited ("AptFuel," "we," "us," or "our") which makes it easy to access petroleum products at your own convenience using technology. Please carefully read, understand and accept these terms and conditions of use (the "Terms") here before using the AptFuel platform as they will govern your access and use to our services. This agreement sets out your rights and responsibilities when you use the AptFuel platform (herein referred to as our “Services”). By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to be bound by these Terms and the Privacy Policy, you may not use the AptFuel platform.
2. Use of the AptFuel Platform
2.1 Authentication
Where any part of the Platform requires you to register in order to use it, you are obliged to provide accurate and complete registration information. It is your responsibility to update and maintain any changes to that information by altering your details as appropriate. The Platform shall be accessed by users only after registration.
- Users can sign up by using either their Gmail account. Information such as first name, middle name, surname, email, phone number and referral code will be required of the user.
- Users are to create and confirm their unique password with the option of showing or hiding same.
- An OTP is sent to confirm the email given.
- Upon completion of registration, users can sign in using either their email or phone number.
- There are options to recover the unique password and to sign in automatically using “Remember me”.
- Your personal details including your email address and password are personal to you and may not be used by anyone else.
- You are solely responsible for all activities that occur under your account, regardless of whether the activities are undertaken by you, your employees or a third party (including a spouse, children and other relatives) and, except to the extent caused by our breach of this Terms.
- You are solely responsible for maintaining the confidentiality of your account login information, for restricting access to your computer/ mobile devices and for all activities that occur under your account. You hereby accept responsibility for any breach, unlawful access, use, compromise, or manipulation of your Personal Information caused by your conduct, inaction, carelessness or negligence. You agree to immediately notify AptFuel of any unauthorized use, or suspected unauthorized use of your account or any other breach of security.
- We and our affiliates shall not be responsible for unauthorised access to your account, and you will contact us immediately you notice an unauthorized third party using your account or if your account information is lost or stolen; and
- You shall comply at all times with the terms herein (as may be amended from time to time).
2.2 Prohibited uses
When using the AptFuel platform, you agree that you shall not do the following:
- Violate any applicable laws or regulations.
- Do anything to assist anyone who is not a registered user to gain unauthorised access to any area of the Platform or use your account to carry out transactions on behalf of a third party.
- Use our services to break the law. You will not use your AptFuel Account for or in relation to any illegal, unlawful, malicious or prohibited activity in violation of any laws, statutes, ordinances or regulations in Nigeria which includes but is not limited to money laundering, financing or terrorism, fraud, racketeering.
- Use the website in any manner that could damage or overburden AptFuel server or maliciously create accounts for the purpose of abusing the functionality of the Platform, or other users, nor do you seek to pass yourself off as another user.
- To record, process, harvest, collect, or mine information about other users.
- Use the website to infringe the intellectual property or other rights of AptFuel or any third party. Also, to remove, or modify any copyright, trademark, or other proprietary rights notice that appears on any portion of the website or on any materials printed or copied from the website.
- Transmit any viruses or other harmful code.
- Use any robot, spider, scraper, or other automated means to access the AptFuel platform.
- Collect or store any personally identifiable information about other users of the AptFuel platform without their express consent.
- Use the AptFuel platform for any commercial purpose without AptFuel’s prior written consent; or
- Attempt to gain unauthorized access to the AptFuel platform or any part of it.
- You agree that we may take civil or criminal actions against you if we have reason to believe that you have used or attempted to use our services in any manner prohibited above.
2.3 Eligibility
By opening a AptFuel Account, you expressly warrant and represent that:
- You are 18 years of age or older. (in the case of individuals) or validly registered/incorporated in Nigeria (in the case of businesses);
- Nigerian citizens/legal residents in Nigeria;
Any access to the Platform or use of the Services by any person or entity who does not meet up with the above criteria is not allowed or permitted and shall be in violation of these Terms of Use.
2.4 License to use
Subject to your compliance with these Terms, AptFuel grants you a limited, non-exclusive, non-transferable, revocable license to access and use the AptFuel platform for your personal and commercial use.
2.5 Modifications to the AptFuel Platform
AptFuel reserves the right to change, modify or discontinue, temporarily or permanently, the AptFuel platform or any part of it, with or without notice. You agree that AptFuel will not be liable to you or to any third party for any modification, suspension, or discontinuance of the AptFuel platform. If we believe that the changes are material, we will let you know by posting the changes on our services. That way you decide whether or not you want to use our services. You are responsible for reviewing and becoming familiar with any of the changes made. Your use of the service following the changes made constitutes your acceptance of the modified platform.
3. Station Finder
AptFuel provides the station of a service finder allowing users to search and find nearby fuel stations that sell or have fuel, based on their current location or entered location. The station finder allows the user access to the following features:
- Locate fuel stations around the user's current area: This function allows the user to find fuel stations in their immediate vicinity.
- Locate fuel stations in other locations: This function allows the user to search for fuel stations in a specific location, such as a state, LGA etc. they plan to visit or a route they plan to take.
- Fuel station information’s: The user should be able to see the name, Price, availability, ratings, reviews, and address of the fuel station they want to locate.
- Name of fuel station: The fuel station should clearly state the common and represented name of the fuel station
- Price: A breakdown of fuel station price rate should be shown, in the likes of petrol, kerosene, diesel, and cooking gas
- Availability: The user should be able to see if the fuel station is opened or closed. It should also show if a fuel station has fuel, in the likes of petrol, kerosene, diesel, and cooking gas
- Fuel station address: Coordinates and full address of the fuel station should
- Map: The user should be able to use a map to navigate directly to a fuel station (This feature provides a visual representation of gas stations and other important locations such as repair shops, traffic conditions, and nearby amenities on a map)
- Queue tracker: The user should be able to track the status of queues at gas stations, which can help them make informed decisions on when to visit and avoid long waits.
4. Wallet
With AptFuel, users can make payments for all provided services using the wallet embedded in the app. Users can:
- Fund their wallet via transfers from their local bank(s), or via credit card(s).
- Send money via wallet to wallet (in-app) or wallet to bank.
- Add, save, delete and view beneficiaries saved on the wallet.
- Only withdraw from AptFuel by transferring money to their local banks.
- Scan another user’s information quickly for seamless transactions.
- View the history of all transactions made on the app for a specific period. Each transaction history shall include; the fuel station name, branch, fuel attendant id, amount and time of transaction.
- Generate, share and download the transaction receipts showing details such as fuel station name, branch, fuel attendant id, amount, vat and time of transaction.
- Upon registration on the app, each user has a unique QR Code that stores information such as account details.
5. News Feed
This feature affords users access to up-to-date news and information related to the downstream sector, including gas prices, promotions, safety alerts, and other relevant updates.
6. Quick Fix / Self Help
Users can search through the available videos and information that have been uploaded to get quick and easy solutions which can help address minor issues common in vehicles.
7. Ratings and Reviews
Rating and Reviews of gas stations, products, and services, can be seen by all users of the app which provides valuable feedback to other users and subsequently stakeholders in the downstream sector. The rating ranges from 1 star to five stars. The user can also view the history reviews made by other users. Users are prohibited from using Ratings and Reviews of gas stations, products, and services to commit any fraudulent acts.
8. Settings
In a bid to ensure the safety of the mobile app, all users are entitled to the following options of settings:
- Profile; all personal details which show a user’s profile excluding email and phone number provided by a user can be altered in the app.
- Password; this can be changed at any point in time by the user.
- Transaction Pin; can be changed by users.
- Lock app; the app can be locked with either the user’s password or fingerprints.
- Monthly Limit; users can determine the number of transactions they wish to have in a month by setting a monthly limit.
9. Fees and Payments
9.1 Fees
AptFuel may charge fees for certain features or services of the AptFuel platform. Any such fees will be disclosed to you before you use the feature or service.
9.2 Payment
You agree to pay all fees in accordance with the fees and payment terms disclosed to you before you use the feature or service. You authorize AptFuel to charge your chosen payment method for any fees incurred by your account.
10. Intellectual Property
You acknowledge that the AptFuel platform is protected by applicable copyrights, trademarks, trade secrets, patents, proprietary rights, and other intellectual property laws and that these rights are valid and protected in all forms, media, and technologies existing now or developed in the future. Accordingly, you may not copy, distribute or modify the website, including any text, graphics, user interface design or logos, except as explicitly authorized by us in writing.
10.1 Ownership
All intellectual property rights in the AptFuel platform, including without limitation the AptFuel name and logo, are owned by AptFuel or its licensors. You acknowledge and agree that you do not acquire any ownership rights in the AptFuel platform by using it.
10.2 License to User Content
You grant AptFuel a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any content that you post or otherwise submit to the AptFuel platform ("User Content") for any purpose, including without limitation for marketing and promotional purposes.
11. Disclaimer of Warranties
You acknowledge and agree that the AptFuel platform is provided on an "as is" and "as available" basis and the service provider, AptFuel and their respective affiliates hereby expressly disclaim any and all warranties of accuracy, reliability, title, merchantability, non-infringement, fitness for a particular purpose, or any other warranty, condition, guarantee or representation, whether oral, in writing or in electronic form, including but not limited to the accuracy or completeness of any information contained therein or provided by AptFuel platform. Without limiting the foregoing, AptFuel does not warrant that the AptFuel platform will be uninterrupted or operate without errors, or that the AptFuel platform will be available and operational at all times.
12. Limitation of Liability
Except as specifically provided in this agreement, or otherwise required by law, you agree that AptFuel, its, officers, employees, or agents are not liable for any indirect, special, incidental, consequential, or punitive damages, under or by any reason of any services or products provided under this agreement or by reason of your use of or access to AptFuel platform. AptFuel reserves the right to change, suspend, or discontinue any of the services at any time, for any reason. We will not be liable to you for the effect that any changes to the services may have on you. Further, in no event shall the liabilities of AptFuel and its affiliates exceed the amounts paid by you for the services provided to you through the AptFuel platform.
13. Indemnification
In the event that AptFuel gets sued for your action or inaction, you agree to indemnify and defend us. That means you will defend AptFuel, its directors, officers, employees, and agents and hold us harmless from and against any claims, actions, suits, or proceedings, as well as any losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the AptFuel Services, your User Content, or your breach of these Terms. We reserve the right to handle our legal defense however we deem fit, even if you are indemnifying us, in which case you agree to cooperate with us so we can execute our strategy.
14. Governing Law and Dispute Resolution
These Terms and your use of the AptFuel platform shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. You agree that any claim, complaint, controversy, or dispute arising out of or in connection with your use of the AptFuel Platform (‘Dispute’) shall be resolved by mutual consultation between You and AptFuel only. It is agreed that any dispute which cannot be mutually resolved by the parties within 30 (Thirty) days of the parties taking steps to resolve the dispute shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act Cap A18 Laws of the Federation of Nigeria 2004. The parties shall jointly appoint a sole arbitrator. Where the parties are unable to agree on the choice of an Arbitrator within 14 (Fourteen) days from when the party giving notice has requested that the matter be referred to arbitration, any party may apply to the Chairman of the Chartered Institute of Arbitrators, UK (Nigeria Branch) to appoint an arbitrator. The place of arbitration shall be Lagos State, Nigeria and the proceedings shall be in English Language. The resulting arbitral result shall be final and binding and judgment upon such award may be entered in any court having jurisdiction thereof. Notwithstanding the above, you hereby agree that AptFuel reserves the exclusive right, at its option, to institute legal proceedings regarding any dispute in any Nigerian court of law.
15. Miscellaneous
15.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and AptFuel with respect to the AptFuel platform and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and AptFuel.
15.2 No Waiver
The failure of a party to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
15.3 Severability
If any provision of these Terms is held to be invalid, void, unlawful or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
15.4 Assignment
You may not assign these Terms or any of your rights or obligations under these Terms without the prior written consent of AptFuel, and any attempted assignment without such consent will be null and void. AptFuel may assign these Terms or any of its rights or obligations under these Terms without your prior written consent.
15.5 Third-Party website
If there are other websites and resources linked to on the services, these links are provided only for the convenience of our users. We have no control over the contents of those websites or resources, and therefore cannot accept responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party website linked to the services, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.

16. Amendment These Terms
Aptfuel reserves the right to modify these Terms at any time, in its sole discretion, and may as well amend the Terms from time to time. You should visit the terms and conditions page on the Platform regularly to check when the Terms were last updated (as displayed at the top of this document) and to review the current Terms. We will do our best to notify you of any amendments to the Terms that we consider likely to materially affect your rights and obligations. Any such notice will be posted on the Platform, or sent to the email address associated with your Aptfuel Account. By continuing to use the Aptfuel platform after we have posted the revised Terms, you agree to be bound by the revised Terms.
17. Termination
Aptfuel may terminate your access to the Aptfuel platform at any time, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
18. Notice
Any notice or other communication required or permitted under these Terms must be in writing and delivered by hand or sent by registered mail, courier, or email to the address specified by the receiving party.
19. Language
These Terms may be translated into multiple languages for convenience. In the event of any conflict between the English language version and any translated version, the English language version will control.
20. Privacy
We know your personal information is important to you, so it is important to us. Our Privacy Policy details how your information is used when you use our services. By using our services, you are also agreeing that we can process your information in the ways set out in the Privacy Policy, so please read it here.
